1. Who you are buying from

Southern Sons Co. is a brand of VantArc e.U., a registered sole proprietorship owned by Friedrich Scharinger, Schillerstraße 19, 4209 Engerwitzdorf, Austria. Company register FN 674605 t, Regional Court of Linz. VAT ID ATU83199049. Email info@southernsons.store. Full details are in our Impressum.

These terms apply to every order placed at www.southernsons.store. They are written for consumers. Where a rule here differs from the mandatory consumer law of your country, that law applies.

2. Who can order

You need to be at least 18, or have the consent of a parent or guardian. We currently deliver to addresses in the European Union only.

3. Our products

Each product page gives the cloth, its full composition, the measurements and the price. We show and describe every piece as accurately as we can. Colours can look slightly different from screen to screen. The composition and measurements on the product page are what count.

A product shown in the shop is not yet an offer. It is an invitation to place an order.

4. How the contract is made

1. You choose a piece, size and quantity and add it to your cart.
2. At checkout you enter your contact, delivery and payment details. Before you pay, you see a summary of the products, the total price and the delivery address. Until then you can check and correct every entry.
3. With the final button at checkout you make a binding offer to buy.
4. You immediately receive an email confirming that we have received your order. That email is not yet acceptance. The contract is made when we accept your order in a further email or ship the goods, whichever comes first.
5. If we cannot accept an order, for example because a piece is no longer available, we tell you within five working days and refund anything you have paid, in full and straight away.

The contract languages are English and German. Your order details are sent to you by email. These terms are always available on this page, where you can save or print them. We keep a record of your order, and if you have a customer account you can view it there.

5. Prices and payment

All prices are in euros and include VAT. Standard shipping within the EU is free. Import charges are included, and nothing is collected on delivery. The price that applies is the one shown when you place your order.

You pay with the methods offered at checkout. Payment is taken when you place your order. If no contract comes about, we refund the amount in full. Your invoice is sent by email.

If a price is obviously wrong, we tell you before we ship. You then decide whether to buy at the correct price or have us cancel the order and refund you in full.

6. Delivery

Delivery times are shown on our Shipping page and at checkout. Until the goods reach you, or a person you have named to receive them other than the carrier, the risk of loss or damage stays with us.

7. Retention of title

The goods remain our property until they are paid for in full.

8. Right of withdrawal and returns

As a consumer you have a statutory right of withdrawal of 14 days. On top of that, we offer a voluntary return within 30 days. The full withdrawal information, the model withdrawal form and the withdrawal function are on our Returns and Refunds page.

9. Warranty

The statutory warranty under Austrian law applies (Verbrauchergewährleistungsgesetz, VGG), for two years from delivery. If a defect appears within the first year, it is presumed to have existed at delivery. If a piece is defective, you are first entitled to repair or replacement, and under the conditions set by law to a price reduction or to end the contract. We bear the costs of this. We give no commercial guarantee beyond the statutory warranty.

10. Liability

We are liable without limit for personal injury and for damage caused intentionally or through gross negligence. For other damage caused through slight negligence, our liability is excluded to the extent the law permits. Liability under the Austrian Product Liability Act is not affected.

11. Customer account

If you create an account, keep your login details private and tell us if you suspect misuse. We may suspend an account that is used for fraud or other unlawful purposes.

12. Content of this website

The text, images and design of this website are protected by copyright, as set out in our Impressum. You may view and save them for your own private use. Any other use, including automated copying or scraping, requires our prior written consent.

13. Privacy

How we process your personal data is explained in our Privacy Policy.

14. Our store platform

Our store runs on Shopify. Your contract of sale is with us alone, not with Shopify.

15. Changes to these terms

We may change these terms for future orders. Your order is governed by the version shown on this page when you placed it.

16. Applicable law and courts

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. As a consumer you keep the protection of the mandatory law of the country where you normally live. You can take legal action against us in the courts of your home country or in Austria. We can only take legal action against you in the courts of your home country.

If something goes wrong, write to us first. We do not take part in dispute resolution proceedings before a consumer arbitration board.

17. Invalid provisions

If any provision of these terms is invalid, the rest remain valid. The invalid provision is replaced by the statutory rule.
